What Are the Grounds for Modifying a Child Custody or Child Support Order?

Under Tennessee law, a parent may ask the court to modify an existing child custody or child support order if there has been a substantial change in circumstances since the order was entered. A "substantial change in circumstances" may include a change in income or a change in the child's needs.

Child custody modifications may be requested if there has been a change in the children's living arrangements, or if there has been a change in a parent's work or health situation, among other changes. If a parent's income has changed and they are now able to pay a higher support amount, they may ask the court to modify the order.

Child support modifications may be requested if a parent's income has changed, or if the children's needs have changed since the order was entered. For example, if a child needs braces and the parent's dental plan no longer covers the child, the parent may ask the court to modify the child support order to include dental coverage.

Modifications of child custody and child support orders are complicated matters that require the assistance of an experienced family law attorney who is familiar with the procedures for modifying such orders in Tennessee.
